1. Introduction

These Terms of Use ("Terms") govern your access to and use of the Love Your Accountants mobile application (the "App"), operated by Love Your Accountants Limited ("LYA", "we", "us", or "our"), a company registered in England and Wales with company number 10775733, whose registered address is 2A The Quadrant, Epsom, Surrey, KT17 4RH.

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.

These Terms should be read alongside our Privacy Policy, available at https://loveyouraccountants.com/app-privacy-policy, which explains how we collect and handle your personal data.

2. Who Can Use the App

Access to the App is strictly limited to current clients of Love Your Accountants Limited. The App is not available to the general public.

To use the App, you must:

  • Be a client of LYA and have been granted access by us.
  • Be aged 18 or over.
  • Use the App solely in connection with the accountancy services LYA provides to you.

Access is granted entirely at LYA's discretion. We reserve the right to grant, refuse, suspend, or revoke access to the App at any time and for any reason, including but not limited to the end of your client relationship with LYA. When a client is offboarded, LYA will manually revoke their App access as part of that process.

You may not share your account or allow any other person to access the App using your credentials.

3. What the App Does

The App has a single purpose: to allow LYA clients to submit receipt images and financial documents to LYA as part of the accountancy services provided to them.

Within the App, you may:

  • Sign in using your registered email address via a passwordless login link.
  • Upload photos of receipts and financial documents using your device's camera or photo library.
  • Delete your account at any time.

You may not use the App for any other purpose. Any use outside of the above constitutes a breach of these Terms and may result in your access being revoked.

4. Acceptable Use

You are responsible for all content you upload through the App. You agree that you will only upload:

  • Photos of genuine receipts or financial documents that are directly relevant to the accountancy services LYA provides to you.
  • Images that you have the legal right to share.

You must not upload, share, or submit through the App:

  • Inappropriate, offensive, defamatory, or illegal content of any kind.
  • Images or documents belonging to a third party without their express permission.
  • Anything that is unrelated to your accountancy with LYA.
  • Content that infringes the intellectual property rights of any person or organisation.
  • Content that is false, misleading, or fraudulent.

LYA reserves the right to remove any content that we consider to be in breach of these Terms, and to suspend or permanently revoke your access to the App without notice where we reasonably believe misuse has occurred.

5. Intellectual Property

The App, including all associated software, design, code, and content, is owned by or licensed to Love Your Accountants Limited. Nothing in these Terms transfers any intellectual property rights in the App to you.

Note: the precise ownership of the App's software as between Love Your Accountants Limited and M24 Media Ltd (the App's developer) is governed by a separate agreement. You should confirm the applicable ownership position with your solicitor.

You retain full ownership of any images and documents you upload through the App. However, by uploading content, you grant LYA a non-exclusive, royalty-free licence to use, store, and process that content for the sole purpose of providing accountancy services to you. This licence ends when your account is deleted and your data has been fully removed in accordance with our data retention policy.

6. Limitation of Liability

To the fullest extent permitted by applicable law, LYA shall not be liable for:

  • Any technical issues, interruptions, downtime, or loss of access to the App, whether planned or unplanned.
  • Any loss, corruption, or deletion of data, including receipt images, whether caused by technical failure or otherwise.
  • Any errors, omissions, or inaccuracies in the accountancy work arising directly from receipts or documents that you have submitted incorrectly, incompletely, or in a misleading manner.
  • Any loss or damage arising from unauthorised access to your account where you have failed to keep your login credentials or device secure, or where you have shared access with a third party.

Nothing in these Terms excludes or limits LYA's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law, including any rights you may have under the Consumer Rights Act 2015.

Note: this limitation of liability clause should be reviewed and finalised by a qualified solicitor to ensure it is enforceable under UK consumer and commercial law in the context of your specific client relationships.

7. Account Termination

You may delete your account at any time by using the account deletion feature within the App, or by contacting us at management@loveyouraccountants.com.

LYA may suspend or terminate your access to the App at any time, without prior notice, in particular where:

  • Your client relationship with LYA ends for any reason.
  • You breach any of these Terms.
  • We are required to do so by law or regulation.
  • We decide to withdraw or discontinue the App.

Upon termination or deletion of your account, receipt images stored on the App will be automatically deleted within 30 days, in accordance with our Privacy Policy at https://loveyouraccountants.com/app-privacy-policy. Your account data will be removed upon deletion.

8. Changes to the App and These Terms

LYA reserves the right to update, modify, or discontinue the App, or any part of it, at any time without prior notice.

We also reserve the right to update these Terms at any time. Where we make material changes, we will notify you either by email to your registered email address or by an in-app notice. The updated Terms will display a revised "Last updated" date at the top of this page.

Your continued use of the App following notification of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App and may delete your account as described in Section 7.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
